1. Acceptance of Terms

By using the AnswerSignal™ website, submitting an application, or engaging with our services, you agree to comply with and be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations.

2. Description of Services

AnswerSignal™ provides digital marketing and search optimization services designed to secure top positions in Google Map Pack and AI Search results for local service businesses. Our services include:

• Strategic data optimization
• Dual-engine targeting (traditional search + AI platforms)
• Review management and reputation monitoring
• Territory exclusivity (limited to 3 partners per niche per city)
• AI-powered lead capture and communication tools

3. Eligibility

To apply for and use our services, you must:

• Be at least 18 years of age
• Operate a legitimate business with a professional website
• Have the authority to enter into this agreement on behalf of your business
• Provide accurate and truthful information in your application

4. Application Process

4.1 Preliminary Approval:

Submission of an application does not guarantee acceptance into the AnswerSignal™ program. Preliminary approval is based on your initial responses and is subject to final qualification during the Territory Analysis Call.

4.2 Territory Exclusivity:

We operate on a "First-Locked" basis. Once a business secures a territory seat for a specific niche and city, we will not accept competitors in that territory. Territories are assigned on a first-come, first-served basis.

4.3 No Guarantee of Availability:

By the time of your Strategy Call, your territory seat may no longer be available if another qualified applicant has already secured it.

5. Payment Terms

5.1 Pricing:

AnswerSignal™ services are customized based on market size, territory scope, and business requirements. Pricing starts at $12,000 for a 3-month upfront commitment, with ongoing monthly investment thereafter. Exact pricing will be provided during your Territory Analysis Call and outlined in your service agreement.

5.2 Payment Schedule:

Payment for the initial commitment period is due upon signing the service agreement. Thereafter, ongoing monthly payments are billed every 30 days from your service start date.

5.3 Multiple Territories:

Clients securing multiple territories or additional services may be subject to adjusted pricing as outlined in their service agreement.

5.4 Refund Policy:

Due to the exclusive nature of our territory-based services and the resources allocated upon onboarding, all payments are non-refundable after the service agreement is signed.

5.5 Cancellation Policy:

You may cancel your AnswerSignal™ services at any time by providing 30 days' written notice to [email protected].

Monthly Billing: If you are billed monthly (every 30 days from your start date), your cancellation will take effect 30 days after we receive your notice. Depending on your next scheduled billing date, you may be billed 0 or 1 additional times during the 30-day notice period. Your services will remain active through the end of your final paid billing cycle.

Annual Billing: If you are on an annual payment plan, you may cancel at any time up to 30 days before your annual renewal date. Since annual plans are paid in full upfront (at a discounted rate), no refunds or pro-rated amounts will be issued. Your services will remain active through the end of your current annual term.

Territory Release: Upon the effective date of your cancellation, your territory exclusivity will be released and made available to other qualified businesses. No further billing will occur after your final paid billing cycle concludes.

No Pro-Rations or Refunds: All payments are non-refundable, and we do not issue pro-rated refunds for partial billing periods.

6. SMS/Text Message Terms

6.1 Consent:

By providing your phone number and opting in to receive text messages, you consent to receive SMS communications from AnswerSignal™, including:

• Appointment confirmations and reminders
• Application status updates
• Territory availability notifications
• Marketing and promotional messages (optional)

6.2 Opt-Out:

You may opt-out of SMS communications at any time by replying STOP to any message. You will receive one final confirmation of your opt-out.

6.3 Message Frequency:

Message frequency varies. You may receive up to 10 messages per month during active engagement.

6.4 Carrier Charges:

Standard message and data rates may apply. AnswerSignal™ is not responsible for carrier charges.

7. Client Responsibilities

You agree to:

• Provide accurate and complete information about your business
• Respond promptly to communication from our team
• Maintain an active, professional website throughout the service period
• Comply with all applicable laws and regulations in your business operations
• Refrain from engaging in fraudulent, deceptive, or unethical business practices

8. Service Expectations and Disclaimers

8.1 No Guaranteed Results:

While we strive to deliver exceptional results, we do not guarantee specific outcomes, rankings, or lead volumes. Results vary based on market conditions, competition, and other factors outside our control.

8.2 Industry Averages:

Statistics such as "327% average visibility increase" and "89% AI recommendation rate" represent averages across our client base and are not guarantees of individual performance.

8.3 Third-Party Platforms:

Our services optimize your presence on third-party platforms (Google, AI search engines, review sites, etc.). We do not control these platforms and cannot guarantee their policies, algorithms, or availability.

9. Intellectual Property

All content, trademarks, logos, and materials on the AnswerSignal™ website and in our service deliverables are the property of Digitalutions LLC or our licensors. You may not use, reproduce, or distribute any content without our written permission.

10. Limitation of Liability

To the fullest extent permitted by law, AnswerSignal™ and Digitalutions LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, business interruption, or loss of data.

Our total liability for any claim related to our services shall not exceed the total amount you paid to us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AnswerSignal™, Digitalutions LLC, and our affiliates from any claims, damages, or expenses arising from:

• Your breach of these Terms of Service
• Your violation of any law or regulation
• Your business practices or misrepresentation of services

12. Termination

We reserve the right to terminate or suspend your access to our services at any time, with or without cause, including if you:

• Breach these Terms of Service
• Provide false or misleading information
• Engage in fraudulent or unethical conduct
• Fail to make timely payments

Upon termination, your territory exclusivity will be released, and you will remain responsible for any outstanding payments.

13. Dispute Resolution

13.1 Governing Law:

These Terms of Service are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

13.2 Arbitration:

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in North Carolina.

13.3 Class Action Waiver:

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit.

14. Changes to These Terms

We may update these Terms of Service from time to time. The "Last Updated" date at the top of this page indicates when the terms were last revised. Continued use of our services after changes constitutes acceptance of the updated terms.

15. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AnswerSignal™ regarding your use of our services.
